Terms and conditions of use of the LIEU.CITY platform
These General Conditions of Use (hereinafter, for brevity “Terms and Conditions”) govern the methods of use of the products and services promoted and offered on the “LIEU.CITY Virtual Reality for Art Fairs (not for nerds)” platform ( henceforth, for the sake of brevity, the “Site” or also the “App” or “LIEU.CITY”) at the URL https://new.lieu.city/privacy-e-cookie-policy/ owned by LIEU.CITY Srl, with registered office in Via Carlo Forte 60, 09123 – Cagliari (CA), VAT number 03929700924 (from now on the “Owner”) and the relations between the Owner and the Users of the Site / App (from now on ” User “or” Users “or” Visitor “).
The Owner, through the following conditions, regulates the methods of registration, use of the Platform and use of products and services offered by it.
The User who accepts these Conditions is authorized to access the Site or the App and use the Contents. By “Contents”, we mean, by way of example, the virtual art fairs, the works of art exhibited in them, the exhibition stands and the multimedia contents of the related fairs, as well as any other verbal, figurative or audio element present at inside the Site / App.
The Services of the Site / App are available only to Users of age. By accepting these “Terms and Conditions”, the User therefore declares to be of age and to be able to contract binding legal obligations arising from the use of this Site / App. In case of violation of these “Terms and conditions” or in case of violation of its internal policies, LIEU.CITY may, at its sole discretion, prohibit access to the Site / App or suspend, even temporarily, the services provided through of the same.
LIEU CITY may at any time modify these “Terms and conditions”. Therefore, a careful reading is recommended every time you use the Site / App to check for any changes.
The changes will be effective from the day of their publication on the Site / App.
LIEU.CITY is a “not for nerds” platform that automatically generates virtual art fairs.
The setting up of virtual art fairs includes, by way of example but not limited to, art galleries, art fairs, auction houses and museums and will be entirely managed by the Fair Organizers, belonging to the fair body (of followed, also, “Organizer” and / or “Organizers”) and by individual gallery owners (hereinafter “Gallery owners”. For the sake of brevity with reference to both Organizers and Gallery owners “Content Supplier”). LIEU.CITY provides virtual spaces of the platform to the Organizers for the online preparation of fairs and exhibitions, which will be entirely curated and organized by them, and subsequently also made available to individual Gallerists, who will have the possibility to import the works within virtual spaces assigned to them.
The virtual art fair consists, by way of example and not limited to, in the preparation of stands, pavilions in the exhibition of works of art from museums or galleries and in the creation of multimedia content ..
The Site / App allows the User to view the Contents, after registering an account in the manner indicated below. Once the registration is complete, the User can customize their profile, visit the virtual art fairs set up, interact with the Content Providers, create a list of favorite works and access in-depth multimedia content (for example: audio guides ; videos; photographs of works etc.).
Users will be able to access the Contents of the Site / App, after registering an account, through the use of any electronic device. Users undertake to use and communicate truthful data. Account registration takes place through access to the dedicated Reserved Area: the User must enter the data required to create a personal page, including name, surname, e-mail and password. In creating the profile, the User can customize his page by entering additional personal information, including, by way of example and not limited to: interests; preferences; works
During the fair, the Visitor can be followed in his activity by the Organizer and the Gallery owner, to track the preferences of the Visitor himself: the Organizer and the Gallery owner can see where the Visitors are, how they move around the Fair , which works attract the attention of the public most. The virtual art fairs that will be visited by the User will be annotated on the personal page and may be visible by other Users, gallery owners and fair organizers. In some cases, access to virtual fairs may be allowed, upon reservation and choice of a pre-established time. When setting up a new exhibition, the User will be notified and will have the opportunity to create a wishlist of the works. During the visit, the User will have the opportunity to save their favorite works. At the end of the visit, the User can return to all the works that have already been seen. This function will remain active within the User’s personal profile, without time limits.
Through his personal page, the User can interact with other visiting Users, with the organizers of the fair and with the Gallerists.
When registering the account, the User accepts these Terms and Conditions.
The access data to the Site / App (user ID / e-mail and password) are strictly personal and cannot be transferred to third parties. The User is required to exercise the utmost diligence in the use and custody of the aforementioned credentials. During the existing relationship with the Owner, the User will be identified as the owner of his rights and duties – in relation to all services – exclusively on the basis of the digital identity attributed to him and represented by the credentials (user ID / e-mail and password) that he has indicated and / or chosen. The User therefore undertakes to keep the access data and immediately report any loss of exclusive control over them to the email address [email protected], taking note of the fact that he will be responsible for any action and conduct carried out using these credentials and cannot in any way contest the use of the services or access to the contents connected to the use of the aforementioned credentials.
In the creation of a personal page in the Reserved Area, the User guarantees that the information and contents created in it are not harmful to the property, moral or personality rights of third parties (including honor and confidentiality), assuming responsibility and holding the Owner harmless. from any claims made by third parties.
LIEU.CITY reserves the right to remove the contents or the User’s personal page, if, in the sole discretion of LIEU.CITY, they do not comply with the purposes of the Site / App or are harmful to the rights of third parties. Furthermore, the Data Controller reserves the right to act to protect its interests pursuant to the law, towards Users and anyone who has made available and / or used the service in violation of these Terms and Conditions, suspending the service and revoking the account.
3.Purchase and payment methods
Creating an account does not involve any cost on the part of the User.
At the discretion of the Organizer, payment of a fee may be required for admission to a virtual art fair, exhibition and / or exhibition.
The transaction takes place within the Platform, according to the following methods: the Visitor accesses the personal account, selects the exhibition and pays the ticket price by paying by credit card, debit card or other payment instrument available on the Platform .
The Visitor may decide to purchase Content during the visit and must contact the Organizer and / or the Gallery owner to determine the price, through the contact details that can be viewed in their profiles.
The Site / App is the exclusive property of LIEU.CITY, which owns all intellectual and industrial property rights.
The Contents offered by the Site / App are owned by the Organizers and Gallery owners and / or its licensors, unless otherwise indicated; Italian and European copyright laws are applicable to it as well as international conventions on copyright and related rights; any materials taken from other sources are also protected by copyright.
It is strictly forbidden, by law, to copy or download the Site / App in whole or in part, without the prior explicit authorization of the owner. Any total or partial reproduction, modification or use of texts, sounds, videos, images, logos, trademarks, interfaces and screens on the Site / App, and more generally of any other intellectual property right connected to the Site / App, regardless of the reason or means used, is strictly prohibited.
The User also undertakes not to use, without being entitled to, the Content published within the Platform. In using the Site / App, the Visitor undertakes not to post false, inaccurate, misleading, defamatory or libelous comments or data; not to provide untrue Feedback aimed at destabilizing the system set up by the Platform
For the purposes of these conditions, the use of the aforementioned materials on any other website or network environment for any purpose is not permitted. Mirroring of the Site / App, as well as the decompilation, modification or creation of derivative works from the Site / App or from the Contents published therein is prohibited, without the prior authorization of the owners.
5. Trademarks, domains and distinctive signs
The LIEU.CITY domain is a domain registered by the Owner. All rights are reserved by LIEU.CITY. Registered and unregistered trademarks, domain names, logos, titles and headings and any other distinctive sign, even atypical, cannot be used without the authorization of the Owner.
The graphics, structure and any other element of the Site / App cannot be copied, imitated, retransmitted or used, either in whole or in part, without the written authorization of the Owner.
It is forbidden for the User to interfere with or interrupt the services provided by the Site / App. The User assumes exclusively all civil and criminal liability for the uploading of any material that contains viruses or other codes, files or programs created to interrupt, destroy or limit the operation of software, hardware or systems in general.
The User agrees not to use the Site / App for chain letters, unsolicited commercial mail, “spamming”, requests (commercial or non-commercial) or large communications of any kind, including, but not limited to, distribution lists to persons who have not granted specific authorization for inclusion in such lists. Furthermore, the User agrees not to create a hyperlink from sites controlled by him or to this Site without the explicit written authorization of the Owner.
The User agrees not to use any automatic device or to carry out any manual process, which are able to monitor or copy the contents of the Site or other content or information contained therein.
The Site ensures an adequate level of secrecy and security of all the contents it manages, as well as the data entered by the Users. The User is exclusively responsible for the confidentiality of the data in his account, including the password, and for any activity originating from the account itself. It is not allowed to use the data, password or account of another user without the explicit permission and consent of the legitimate owner. The Owner will not be responsible in any way for any loss or damage caused by the failure of the User to comply with these obligations.
8. Personal data
The data provided by the User is collected and processed by the Data Controller, as an independent Data Controller for the provision of the requested services, in full compliance with the provisions of EU Regulation 679/2016 (the “Regulation”).
The data will be processed mainly electronically in order to manage and provide the requested services. Any promotional and marketing activities will be carried out only with the prior consent of the User.
The data acquired as Data Controller will be stored in a protected manner and treated with adequate security measures, in compliance with the provisions of the Regulation.
